If you reside in the United States and you were sent notice that your Private Information was impacted by Eye Physicians Data Breach Incident that occurred in November 2023, then you may be a member of the Class and eligible for benefits. The Class specifically excludes: (1) the Judge in this case, and the Judge's family and staff; (2) Directors and officers of Eye Physicians; (3) anyone who validly excludes themselves from the Settlement; and (4) anyone who perpetrated the Data Breach Incident.

If you are a Class Member and wish to receive Settlement Benefits then you must submit a claim form by May 15, 2026.

All Settlement Class Member who submit a timely and valid Claim Form are eligible to select one or more of the following Settlement benefits:

Credit Monitoring: All Class Members are eligible to enroll in two (2) years of Credit Monitoring by one credit bureau. This benefit comes with $1 million in identity theft insurance.

Documented Ordinary Losses. Class Members who incurred actual, documented out-of-pocket expenses due to the Data Breach Incident, can get back up to $2,000.00, including up to three (3) hours at $25.00 per hour for time spent remedying issues related to the Data Breach. The losses must have occurred between November 5, 2023, and May 15, 2026, and you cannot claim a payment for expenses that have already been reimbursed by a third party. This benefit covers out-of-pocket expenses like:

  • bank fees

  • long distance phone charges

  • cell phone charges (only if charged by the minute)

  • data charges (only if charged based on the amount of data used)

  • postage

  • gasoline for local travel

  • fees for credit reports, credit monitoring or other identity theft insurance products purchased between November 5, 2023, and May 15, 2026.

Documented Extraordinary Losses. Class Members who incurred actual, documented monetary loss due to identity theft or fraud, can get back up to $7,500.00. You cannot claim a payment for expenses that have already been reimbursed by a third party, and you will need to show that:

  • the theft or fraud was probably caused by the Data Breach Incident

  • the losses are not already covered by Out-of-Pocket Expenses

  • you tried to prevent the loss or get your money back, such as by using insurance you already have

If you are claiming for Document Ordinary Losses, and/or Documented Extraordinary Losses you need to provide proof, like credit card statements, bank statements, invoices, telephone records and receipts to show how much you spent or lost. You can also provide notes or papers you made yourself to explain or support other proof, but those notes or papers alone are not enough to make a valid claim. Your proof or notes should show that your expenses were because of the Data Breach Incident

The deadline to submit a Claim Form online or by email is May 15, 2026. If you are mailing your Claim Form, it must be mailed with a postmark date no later than May 15, 2026.
